These Terms of Use constitute a legally binding agreement between you and HDI.Vision (operated by Tomislav Krištof, Radauševa 4, 10000 Zagreb, Croatia - "we", "us", or "HDI.Vision") governing your access to and use of our website at hdi.vision, the assessment platform at test.hdi.vision, and any related services (collectively, the "Services").
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.
1. Our Services
HDI.Vision provides digital wellbeing assessment tools (including the Human Digital Index), education programs, consulting services, and related content. The information provided through our Services is intended for general informational and educational purposes. It does not constitute medical, psychological, or clinical advice.
The Services may include individual results, organization dashboards, group statistics, longitudinal comparisons, retake administration, data export, anonymization request tools, audit logging, and AI-supported improvement reports.
Our Services are available globally, subject to applicable local laws. We make no representation that the content is appropriate or available in all jurisdictions.
2. Intellectual Property Rights
HDI.Vision and Tomislav Krištof own all intellectual property rights in and to the Services, including but not limited to:
- The Human Digital Index (HDI) assessment model and scoring methodology
- The concept of digitality as defined and applied within this platform
- The term and concept of the Digital Sadness Generation
- The 3D, 3S, 3N, 3O, 3F, and 3A intervention models (15 pillars)
- All website design, text, graphics, logos, and software

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Services for personal, non-commercial purposes. You may not copy, reproduce, republish, distribute, or exploit any content for commercial purposes without our express written permission.
3. User Accounts
To access the HDI assessment platform, you must create an account. You agree to:
- Provide accurate and complete registration information
- Maintain the security of your password and account
- Notify us immediately of any unauthorised account use
- Accept responsibility for all activity under your account
You must be at least 16 years old to create an account. If you are under 18, you confirm you have parental or guardian consent.
4. Payments and Refunds
Payment for paid HDI assessments or subscriptions is processed via Stripe or another payment provider shown at checkout. Current prices, taxes, and available plans are displayed before purchase.
Because the comprehensive assessment is a digital product that becomes accessible immediately upon payment, we do not offer refunds once you have accessed the test platform. If you experience a technical problem preventing access, contact us at info@hdi.vision within 48 hours of purchase.
5. Prohibited Activities
You may not use the Services to:
- Systematically extract, scrape, or copy content to create competing products or databases
- Attempt to reverse-engineer, decompile, or disassemble any part of the platform
- Circumvent security measures or access accounts other than your own
- Upload or transmit viruses, malware, or other harmful code
- Impersonate other users or misrepresent your identity
- Use automated tools (bots, scrapers) to access the Services
- Use the Services for any unlawful purpose
- Use HDI results as the sole or determinative basis for hiring, firing, promotion, demotion, compensation, disciplinary, insurance, credit, legal-status, or similar decisions that significantly affect a person
- Use organization dashboards to secretly monitor, rank, profile, or penalize individual participants
- Reproduce or republish HDI assessment results, reports, or frameworks commercially without written permission
5A. Organization Use and Data Protection Responsibilities
If you use HDI on behalf of an organization, you represent that you have authority to do so and that the organization will use HDI lawfully, transparently, and fairly. Organizations are responsible for informing participants about the purpose of the assessment, establishing an appropriate lawful basis, managing internal access, and ensuring that HDI is not used for unlawful employment, disciplinary, surveillance, or automated decision-making purposes.
Organizations may access group-level statistics and dashboards. Individual results are private by default and may be accessed by organization administrators only if the user enables sharing, except where platform super admin access is required for support, security, legal compliance, or troubleshooting. Organizations should ensure that a data processing agreement, data protection impact assessment, internal policy, or employee notice is in place where required by applicable law.
6. Health, Wellbeing, and Assessment Disclaimer
6.1 Not a Clinical or Medical Tool
The HDI assessment and all related reports, scores, and recommendations are provided solely for self-awareness, educational, and research purposes. They do not constitute, and must not be interpreted as:
- A clinical diagnosis, psychological evaluation, or psychiatric assessment
- Medical advice, treatment, or therapy
- A substitute for consultation with a licensed psychologist, psychiatrist, therapist, or other qualified healthcare professional
- Evidence of any mental health condition or disorder under any clinical classification system (DSM, ICD, or otherwise)
Tomislav Krištof and HDI.Vision are not licensed healthcare providers. No clinical, therapeutic, or doctor-patient relationship is created by your use of the Services.
6.2 Not a Medical Device
The HDI assessment platform is not a medical device within the meaning of EU Regulation 2017/745 (Medical Device Regulation) or any equivalent national legislation. It does not diagnose, monitor, treat, or prevent any medical condition or disease. It is a research and educational instrument measuring self-reported patterns of digital behaviour and wellbeing.
6.3 Educational and Research Instrument
The Human Digital Index is a proprietary behavioural research instrument developed for educational purposes and academic research. Results reflect your self-reported responses at a given point in time. Scores are descriptive and informational, not prescriptive or diagnostic. They may vary depending on your mental state at the time of completion, honesty of responses, and other contextual factors.
6.4 AI-Generated Recommendations
HDI improvement reports and personalised recommendations are generated using artificial intelligence (including third-party large language model services). AI-generated content is provided for informational and reflective purposes only. It does not constitute professional advice of any kind - psychological, medical, legal, or otherwise. You should not make significant life or health decisions based solely on AI-generated content. HDI.Vision accepts no liability for any action taken or not taken based on AI-generated recommendations.
For AI report generation, HDI minimizes the data sent to the AI provider and does not send your name, email, organization name, or account identifier for that purpose.
6.5 If You Are in Distress
If you are experiencing a mental health crisis, thoughts of self-harm, or any psychological emergency, please seek immediate professional help. Contact your local emergency services (112 in the EU), your doctor, or a mental health crisis line. HDI.Vision is not equipped to provide crisis support.

6.6 Assumption of Risk and No Liability for Emotional Response
Self-assessment tools may surface information about your digital behaviour that you find unexpected, concerning, or emotionally challenging. By using the Services, you acknowledge and accept that:
- You are voluntarily engaging with a self-reflection tool
- Results may not align with your self-perception
- HDI.Vision is not liable for any emotional distress, discomfort, or adverse reaction arising from review of your assessment results
- You take full responsibility for how you interpret and act upon your results
7. Third-Party Services and AI Processors
The Services integrate third-party tools including Stripe (payment processing), Google Analytics (anonymised usage analytics), OpenAI and Anthropic (AI-powered improvement report generation), and Resend (email delivery). Your use of the Services is subject to the terms and privacy policies of these third-party providers where applicable. HDI.Vision is not responsible for the practices of these providers beyond the contractual safeguards described in our Privacy Policy.
AI-generated content may contain inaccuracies, omissions, or content that is not appropriate for your specific circumstances. HDI.Vision does not warrant the accuracy, completeness, or suitability of AI-generated output.
HDI provides privacy controls including export, anonymization request, privacy sharing controls, audit logs, and aggregate statistics safeguards. These features support compliance but do not replace an organization's own legal and data protection obligations.
8. Service Availability and Modifications
We reserve the right to modify, suspend, or discontinue the Services (or any part thereof) at any time, with or without notice. We are not liable for any modification, suspension, or discontinuance.
We do not guarantee uninterrupted access to the Services. Scheduled maintenance and unexpected downtime may occur.
9. Termination
We may suspend or terminate your access to the Services at our discretion, without notice, if we believe you have violated these Terms or acted in a way that is harmful to HDI.Vision, other users, or third parties. Upon termination, your right to use the Services ceases immediately.
10. Disclaimer of Warranties
The Services are provided on an "as-is" and "as-available" basis. To the fullest extent permitted by law, HDI.Vision disclaims all warranties - express or implied - including fitness for a particular purpose, accuracy, completeness, and non-infringement. We make no warranty that the Services will be uninterrupted, error-free, or free from harmful components, or that any results obtained will be accurate or reliable.
In particular, HDI.Vision makes no warranty that assessment results are clinically valid, scientifically reliable for diagnostic purposes, or suitable for use in any professional, legal, employment, or healthcare decision-making context.
11. Limitation of Liability
To the maximum extent permitted by applicable law, HDI.Vision and Tomislav Krištof shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services, including but not limited to: decisions made based on assessment results; emotional distress arising from results; reliance on AI-generated recommendations; or any failure to seek professional help. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless HDI.Vision and Tomislav Krištof from any claims, losses, damages, or expenses (including legal fees) arising from your use of the Services, your violation of these Terms, or your infringement of any third-party rights.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Republic of Croatia. Any disputes arising from or relating to these Terms shall first be subject to a 30-day informal negotiation period.
If informal resolution fails, disputes shall be resolved by binding arbitration under the rules of the International Commercial Arbitration Court of the European Arbitration Chamber (Brussels), conducted in English. Intellectual property disputes and requests for injunctive relief are exempt from arbitration and may be brought before the courts of Zagreb, Croatia.
14. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date. Continued use of the Services after changes constitutes your acceptance of the updated Terms.
